Only the current leading bid is visible. The leading bidder retains the lead on each vehicle until their maximum bid is EXCEEDED by another bidder. Lastly, second bidding is NOT recommended and is unnecessary if the 'max bid' methodology is followed.

Determining winning bid: The highest valid bid for each vehicle is the winning bid. A winning bid is a binding purchase of the vehicle.

Payment Terms: Each vehicle is sold by a law enforcement agency within Ottawa County pursuant to MCL 257.252(g). The Purchaser must arrange for the payment of all purchased vehicles to the law enforcement agency responsible for the vehicle of the bid price of the vehicle plus the agency auction fee on or before 5:00 p.m. on the fifth (5th) business day after the Auction. Payment must be in cash or credit card. If a credit card is used, an additional charge will be assessed to pay for the credit card transaction. Fee structure is available on our website. Upon payment and presentation of government issued photo identification, the law enforcement agency will issue a written receipt and Bill of Sale.

Purchased Multiple Vehicles: In the event the Purchaser acquires multiple vehicles in the monthly auction and renders payment using more than one payment method, the Purchaser shall retrieve a separate Bill of Sale for each vehicle awarded. Each Bill of Sale must be collected in a single, complete retrieval; partial or staggered pick-up is strictly prohibited. Also, a bidder who successfully bids on multiple cars, may not purchase and pick up one and refuse to purchase and pick up any other or others. All cars will be held until there is full payment on all cars upon which the Purchaser successfully bid. Failure to comply with this requirement may result in the Purchaser's account being designated as inactive for a period of one (1) year from the date of noncompliance.

Separate Payment Types: For bid totals exceeding one thousand dollars ($1,000.00), the Purchaser may tender payment using multiple forms of payment, limited to cash and credit card. Personal checks shall not be accepted under any circumstances.

If any purchased vehicle is not picked up within this same five (5) day period, it will be considered abandoned under MCL 257.252a, and the Purchaser will be subject to a civil infraction, additional storage fees, a civil fine of $50 plus court costs and the Vehicle may be resold pursuant to of MCL 257.252(g). In addition to these remedies, the law enforcement agency may pursue the full purchase price of this Agreement, plus the agency auction fee in a court of law.

Merger and Modification: This represents the entire understanding between the parties and supersedes all prior negotiations, representations or agreements, whether written or oral. This Agreement may be amended only by written instrument signed by the authorized representatives of the Purchaser and the law enforcement agency.

Covenant: Other than an action to enforce the terms of this Agreement, Purchaser covenants not to sue Ottawa County, the law enforcement agency, the Ottawa County Sheriff or any employee or the towing company holding the vehicle regarding the vehicles sold in, administration of, or their participation in this bidding process.

Execution: The Purchaser attests that he or she has the authority to bind the vendor by electronic submission.
